I understand and am aware that my participation in the use of a hot tub, sauna, pool, or cold plunge involves risks, including the risk of serious injury, disability, death, and/or property damage. Such risks may include, but are not limited to: drowning, slipping or falling, heat-related illnesses, heat exhaustion, dehydration, cardiac stress, heart attack, stroke, blood pressure changes, tachycardia, fainting, vomiting, nausea, infection, burns, or other health risks. I agree that these risks may result not only from my own actions but also from the actions or negligence of others, including other customers and Facility employees. It is my sole responsibility to consult with my medical provider and legal counsel about the risks of using the hot tub, sauna, pool, or cold plunge. With the knowledge and understanding of these risks, I voluntarily choose to participate.

I will not start any lawsuit or other court action against Allen Pools & Spas, the Facility, its Owners, Employees, Agents, Affiliates, or Insurers of the hot tub, sauna, pool, or cold plunge, nor will I join any such proceeding, including any claim for money damages for death, physical injury, property damage, or any other damages. I acknowledge and agree that neither Allen Pools & Spas, nor the Facility, its Owners, Employees, Agents, Affiliates, or Insurers have made any assertions or promises regarding whether it is safe for me to participate. I acknowledge and agree that I am entering a covenant not to sue in any capacity. I hereby waive and release any and all claims, now known or hereafter known, against Allen Pools & Spas, the Facility, its Owners, Employees, Agents, Affiliates, or Insurers, and I also waive the right of any of my insurers to make any such claim.

I agree to defend and indemnify the Facility, its Owners, Employees, Agents, Affiliates, or Insurers and hold them harmless against any and all liability, legal claims, demands, or damages that may occur as a result of my use of the hot tub, sauna, pool, or cold plunge.
